Gatchy™ Terms of Service

The short version:

Gatchy lets you catch charity logos in augmented reality inside participating retail stores to trigger a real $1 donation to a charity of your choice — funded entirely by the retailer, at zero cost to you. You watch a short ad, earn a reward, and help a cause. That’s the deal. The legal terms below set out the full picture.

1. About These Terms

These Terms of Service (“Terms”) form a legally binding agreement between you and GoodCompany Technologies Pty Ltd (ACN xxxxxxxx) (“we”, “us”, “our”) governing your use of the Gatchy™ platform, including the Gatchy app, App Clip, Play Instant, website, and any related services (collectively, the “Platform”).

By creating an account or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.

GoodCompany Technologies Pty Ltd operates the Platform commercially. Charitable donations facilitated through the Platform are managed by GoodCompany Foundation Ltd (“Foundation”), a separate registered charitable entity.

2. Eligibility

You may use the Platform if:

  • You are aged 13 or over. If you are under 18, you confirm that you have your parent or guardian’s permission to use the Platform

  • You are capable of entering into a legally binding agreement

  • Your use complies with all applicable laws in your jurisdiction

We reserve the right to refuse access to the Platform to any person at our discretion.

3. Your Account

3.1 Registration

To use core features of the Platform, you’ll need to create an account using your email address and a 4-digit PIN, or by signing in with Apple or Google. You can also try the Platform without an account using App Clip (iOS) or Play Instant (Android) — any catches you make will transfer to a full account if you later register.

3.2  Your Responsibilities

You are responsible for:

  • Keeping your account credentials secure and confidential

  • All activity that occurs under your account

  • Notifying us immediately at support@goodcompany.org.au if you suspect unauthorised access to your account

You must not share your account with anyone else or create multiple accounts for the purpose of gaining an unfair advantage on leaderboards or rewards.

3.3 Account Deletion

You can delete your account at any time via Profile → Settings → Delete Account. Upon deletion, your personal data will be removed within 30 days in accordance with our Privacy Policy.

4. How Gatchy Works

Gatchy enables the following experience at participating retail stores:

  • You open the Gatchy app and point your camera at in-store signage displaying a Gatchy anchor image

  • A 3D charity logo appears in augmented reality. You perform a “swirl” gesture to “catch” it

  • You choose a charity from the available list (2,000+ registered charities)

  • You watch a short brand advertisement

  • A $1.00 donation (or configured amount) is triggered to your chosen charity, funded entirely by the retailer — you pay nothing

  • You receive a reward (e.g. a discount, offer, or promo code) from the retailer

The donation is made by the retailer via GoodCompany Foundation Ltd. You are not donating your own money at any point. Gatchy is not a gambling product — the reward is always delivered on completion of a valid Gatch.

5. Donations

5.1 Donations are funded entirely by participating retailers (“Gatchy Retailers”). You do not contribute any money when performing a Gatch.

 

5.2 Donations are processed by GoodCompany Foundation Ltd, a registered charity with Deductible Gift Recipient (DGR) status, in accordance with the Foundation’s charitable purposes. The Foundation holds donation funds in trust and remits them to your chosen charity.

 

5.3 Charity selection is your choice. You may select any charity from the Gatchy charity registry at the time of your Gatch. The retailer does not control or influence which charity you select.

 

5.4 We do not guarantee that a specific charity will remain on the platform at any given time. Charities may be added or removed from the registry at any time.

 

5.5 Each Gatch generates one donation. You cannot receive multiple donations from the same in-store anchor within a single session unless permitted by the retailer’s active campaign settings.

 

5.6 If you believe a donation was not correctly recorded, contact us at support@goodcompany.org.au within 30 days of the Gatch.

6. Rewards

6.1 Rewards (including discount codes, promotional offers, or in-store offers) are configured and funded by the Gatchy Retailer, not by GoodCompany Technologies or the Foundation.

6.2 Rewards are subject to the terms and conditions set by the individual retailer, including any expiry dates, exclusions, and redemption conditions. These will be displayed at the time the reward is issued.

6.3 We are not responsible for the fulfilment, accuracy, or availability of any reward. Any issues with reward redemption should be directed to the relevant retailer.

6.4 Rewards have no cash value and are not transferable unless otherwise stated.

6.5 We reserve the right to invalidate rewards obtained through fraudulent or abusive behaviour.

7. Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms.

You must not:

  • Attempt to perform Gatches from outside a participating store (e.g. through GPS spoofing or other means of falsifying your location)

  • Use bots, scripts, or automated tools to interact with the Platform

  • Manipulate or tamper with catch records, leaderboard rankings, or reward issuance

  • Create fake accounts or use another person’s account

  • Attempt to reverse-engineer, decompile, or extract source code from the Platform

  • Upload or transmit any content that is unlawful, offensive, defamatory, or infringes any third-party rights

  • Interfere with or disrupt the Platform or its servers

  • Use the Platform in any way that could damage our reputation or the reputation of any charity or retailer partner

Violation of these rules may result in immediate suspension or termination of your account and, where applicable, referral to relevant authorities.

8. Location and Camera Access

8.1 Gatchy requires access to your device’s camera to enable the augmented reality experience. Camera access is only used when you actively open the AR catch screen.

8.2 Gatchy requests access to your device’s location at the moment of a Gatch to verify that you are physically present in a participating store. Location is not tracked continuously and is not stored in retailer-facing analytics.

8.3 You may revoke camera or location permissions at any time in your device settings. Revoking these permissions will prevent you from performing Gatches.

9.  Intellectual Property

9.1 The Platform, including the Gatchy name and logo, the AR catch mechanic, all software, user interfaces, and related content, is owned by or licensed to GoodCompany Technologies Pty Ltd. The AR catch mechanic is patent-pending.

9.2 We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your personal, non-commercial use in accordance with these Terms.

9.3 You must not reproduce, modify, distribute, sell, or create derivative works from any part of the Platform without our prior written consent.

9.4 Charity logos and brand assets displayed within the Platform remain the property of their respective owners and are used with permission.

10. User Content

10.1 If you submit any content to the Platform (including profile information or feedback), you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display that content for the purpose of operating and improving the Platform.

10.2 You warrant that any content you submit does not infringe any third-party rights and complies with these Terms.

10.3 We reserve the right to remove any content you submit that we consider, in our sole discretion, to be in breach of these Terms or otherwise objectionable.

11. Privacy

Your privacy is important to us. Our collection, use, and handling of your personal information is governed by our Privacy Policy, which forms part of these Terms. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.

Key points: your individual data is never shared with retailers; location is verified at catch time only; demographic data is optional; and you can delete your account and all associated data at any time.

12. Third-Party Services

12.1 The Platform integrates with third-party services including Apple Sign In, Google Sign In, and advertising and analytics providers. Your use of these services is also governed by their respective terms and privacy policies.

12.2 The Platform may contain links to third-party websites or content. We are not responsible for the content, accuracy, or practices of any third-party sites.

12.3 Retailer advertising content displayed within the Platform is created and owned by the relevant retailer. We do not endorse any retailer’s products, services, or advertising content.

13. Disclaimers

13.1 The Platform is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

13.2 We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.

13.3 We are not responsible for any technical failure of your device or network that prevents you from completing a Gatch or receiving a

reward.

13.4 The availability of participating stores and active campaigns may change at any time without notice.

14. Limitation of Liability

14.1 To the maximum extent permitted by applicable law, our total aggregate liability to you for any claims arising out of or in connection with these Terms or your use of the Platform shall not exceed AUD $100.

14.2 We will not be liable for any indirect, consequential, incidental, special, or punitive loss or damage, including loss of data, loss of revenue, or loss of opportunity, however caused, even if we have been advised of the possibility of such loss.

14.3 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law, including under the Australian Consumer Law.

14.4 Where the Australian Consumer Law applies, our liability is limited (at our option) to the resupply of the services or the payment of the cost of having the services resupplied.

15. Suspension and Termination

15.1 We may suspend or terminate your access to the Platform at any time, with or without notice, if we reasonably believe you have breached these Terms, engaged in fraudulent or abusive behaviour, or if required by law.

15.2 You may stop using the Platform at any time and delete your account as described in clause 3.3.

15.3 Upon termination, your licence to use the Platform ceases immediately. Clauses that by their nature should survive termination (including clauses 9, 13, 14, 17, and 18) will continue to apply.

16. Changes to the Platform and These Terms

16.1 We may modify, suspend, or discontinue any part of the Platform at any time without liability to you.

16.2 We may update these Terms from time to time. Where we make material changes, we will notify you via the app or by email before the changes take effect. Continued use of the Platform after the effective date of any update constitutes acceptance of the revised Terms.

16.3 The current version of these Terms will always be available at www.gatchy.com.au/terms.

17. Dispute Resolution

17.1 If you have a complaint or dispute, please contact us first at support@goodcompany.org.au. We will make a genuine effort to resolve any issue within 14 business days.

17.2 If a dispute cannot be resolved informally, the parties agree to refer the matter to mediation administered by the Resolution Institute (or its successor) before commencing any court proceedings.

17.3 Nothing in this clause prevents either party from seeking urgent interlocutory relief from a court of competent jurisdiction.

18. General

18.1 These Terms are governed by the laws of the State of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria.

18.2 These Terms, together with our Privacy Policy, constitute the entire agreement between you and us relating to your use of the Platform.

18.3 If any provision of these Terms is found to be unenforceable, that provision will be severed and the remaining provisions will continue in full force.

18.4 Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

18.5 You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
